Judicial Review In High Court
A refusal of an application by the Home Office, UKBA which is without a right of appeal can be challenged by way of Judicial Review in High Court. Before Judicial Reivew (JR) proceedings are initiated, pre-action protocol representations are sent to the Home Office, UKBA giving them 14 days to review the refusal and approve the application. If the Home Office, UKBA do not change their decision within 14 days from the date of receipt of pre-action protocol representations by the Home Office, UKBA, we will then issue the Judicial Review proceedings to challenge the Home Office refusal of your application.
