An application for Indefinite Leave to Remain (ILR) can be submitted to the Home Office,  UKVI on completion of 5 years under the Tier 2 General Category. The applicant has to show that he has been working throughout the period of his work permit / Tier 2 General for the employer who sponsored his stay in the UK. The applicant should also a get a letter from the employer who sponsored his stay in the UK confirming that the applicant has been working for him/her and further that the applicant is still needed for the job for which he was sponsored to stay in the UK. The application Form SET (O) is used to submit the application.

FAQs - Tier 2 General Visa UK

I`m currently 21 years old holding a start-up visa and trying to switch to Tier 2 General Work Visa. Am I eligible for the the Exemption of Resident Labour Market Test RLMT and the Minimum salary 20,800 as a new entrant?

In the given circumstances, you can be treated as new entrant due to your age. According to Appendix J of the Immigration Ruels, new entrant rate will apply if the applicant:

  • was under the age of 26 on the date the application was made; and
  • is applying for entry clearance or leave to remain (not for indefinite leave to remain); and
  • is not applying for a grant of leave that would extend his total stay in Tier 2 beyond 3 years and 1 month.

The exemption from the Resident Labour Market Test (RLMT) does NOT apply when switching from Start-Up visa to Tier 2 General visa.
