How Much Does Civil Litigation Cost in 2025?

Clients are often concerned about unexpected jumps in litigation costs, which can fluctuate between £2,000 to £5,000 in most such cases. At Sunrise Solicitors we stress cost transparency so there are no unexpected costs for our clients as the case continues. If possible, to assess the amount of work and complex issues involved in the matter, we may be able to offer a fixed fee for the whole matter.  Upon agreement, the agreed fee can be paid in the agreed instalments as well.  However, it may not be possible to offer a fixed fee in every matter.  Hence, we would charge the fee on the hourly rate mentioned under.

Disbursements are third-party fees involved in cases of civil litigation. A few common types of disbursements include:

  • Court fees: Payments for issuing claims, submitting applications or setting hearings. These differ depending on the type and worth of the case.
  • Barrister fees: If your case is taken to court, a barrister may be instructed to represent you. Their fees vary according to their seniority and the complexity of the matter.

A No Win No Fee option or Conditional Fee Agreement (CFA) means you will only need to pay legal fees once your case has been won. If you do not win, you will not have to pay your solicitor’s fees, which makes it a low-risk choice for many clients.  However, you will be responsible for paying our fee if you withdraw your instructions prior to the completion of the matter.

Subject to the issue(s) and merits, Sunrise Solicitors also provides expert legal representation on No-Win-No-Fee/ Conditional Fee Agreement (CFA) basis.

The Civil Litigation Process Made Simple

Following is the step-by-step guidance for the civil litigation process:

Step 1: Initial Consultation and Case Assessment

Initially, the solicitor will review your case and assess your chances of success. The solicitor will also estimate the civil litigation fee and other possible costs/disbursements during this process.

Step 2: Pre-Action Negotiation or Mediation

Prior to initiating court action, parties in civil disputes are encouraged to resolve their disputes through negotiation or Alternative Dispute Resolution (ADR), such as mediation. The purpose of pre-action negotiation or mediation is to help resolve the issue without court proceedings with a view to keeping the costs minimum and to save the precious time of the court and public funds if your claim is against a public authority.

Step 3: Court Proceedings and Resolution

If the civil dispute cannot be resolved by negotiation or mediation, the solicitor will begin court proceedings and will file a claim after complying with the Pre Action Protocol procedure. Submission of evidence, preparation of witness statements, conference with barristers/counsels, attending hearings, and trial are included in this process.
