Administrative Review (AR) against refusal of non-Points Based System (non-PBS) work visa applications is a process available to individuals whose applications for work visas outside the PBS framework have been denied. This category includes visas like the Representative of an Overseas Business visa and other specific employment-related visas. If an applicant believes that their refusal was due to a caseworking error, they can request an AR. The review must be initiated within 14 calendar days if the applicant is in the UK, or within 28 calendar days if outside the UK, from the date of the refusal decision. During the AR process, an independent Home Office official, who was not involved in the initial decision, re-evaluates the application to identify and rectify any administrative mistakes. This ensures that applicants have a fair chance to address errors and potentially reverse the refusal, enabling them to proceed with their plans to work in the UK under non-PBS visa categories.
