What is Change of Name Deed?

A Change of Name Deed is a legal document that allows a person to formally declare that they are abandoning their previous name and adopting a new one. It is a unilateral declaration, which means it is made by one party (the individual) and is not a mutual agreement.

This document is used to provide official evidence of a name change and is accepted by:

Who Can Change The Name Using a Deed Poll?

A Change of Name Deed can be used by:

  • Adults (18 years and older): You may change your name for any legitimate reason, provided it is not for fraudulent purposes.
  • Children (under 18): A change of name for a child requires the consent of all individuals with parental responsibility. The deed must also be executed on the child’s behalf.

It is important to note that certain names may be restricted—such as those that contain numerals, symbols, offensive words, or names intended to deceive.

Parental Responsibility is automatically held by the biological mother. A biological father has PR if he was married to the mother at the time of the child’s birth or is named on the birth certificate. If neither applies, the father does not hold PR, and his consent is not required. Where applicable, adoption documentation must be provided.

If consent from all PR holders cannot be secured, it is advisable to seek legal advice to explore alternative legal remedies. For individuals aged 16 or 17, parental consent is not legally required. They may execute a Change of Name Deed independently, provided they have sufficient understanding of the implications of the name change.

What is Adult Deed?

Upon marriage, a Change of Name Deed is not required to adopt your spouse’s surname. In most cases, presenting your marriage certificate will be sufficient for companies and organisations to process the change of name.

The most common circumstance in which adults seek to change their name is following divorce. However, a Change of Name Deed may not be necessary if you are reverting to your maiden name. In such instances, you may provide the Final Order of Divorce (formerly Decree Absolute) along with either your birth certificate or marriage certificate (if it displays your birth name) as acceptable evidence to request a name change.

Each organisation may have its own procedure, but typically this involves completing a standard form and submitting the supporting documents listed above. It is advisable to contact the organisation directly to confirm their specific requirements.

A Change of Name Deed will be required where you are:

Other Types of Change of Name Deed
