How to Make a Discrimination Claim

If you believe you have been discriminated against at work, the process usually begins by raising your concerns directly with your employer. This informal step allows them an opportunity to resolve the issue internally. 

If the matter is not resolved, you should initiate your employer’s formal grievance procedure. Should the outcome remain unsatisfactory, the next stage is to begin ACAS Early Conciliation through Advisory, Conciliation and Arbitration Service, which is a compulsory step before bringing a claim to the Employment Tribunal. 

ACAS will attempt to facilitate a resolution between you and your employer. The process typically lasts up to one month, with a possible 14-day extension if both parties agree. If conciliation is unsuccessful, ACAS will issue a certificate confirming the process has concluded. 

You can then proceed to the Employment Tribunal. Once your claim is submitted, your employer will have 30 days to respond. A full hearing is usually listed within six to nine months. We will support you throughout this period, assisting with evidence, legal arguments, and case preparation. 

Time Limits: You must start the ACAS process within three months less one day from the date of the last discriminatory act. These deadlines are strict, so early legal advice is strongly recommended.
